On July 1, 2026, Virginia expanded the ability to get your record clean through expungement and sealing of your record. There are 1.6 million people in Virginia who may be eligible for this relief.

Charges resulting in acquittal, nolle prosequi, or pardon can be expunged. They can be removed from your record forever! No one will ever see them again.

Misdemeanors and low level felony convictions are eligible for sealing after seven to ten years. Even if you were convicted, if you have been law abiding for seven to ten years, those convictions can be expunged and sealed as well.

The process involves filing a petition, getting fingerprinted and submitting those fingerprints to a local law enforcement officer, sending those fingerprints to the Virginia State Police for production of a criminal history report, providing the documents to the local Commonwealth's Attorney who handled the case, and the scheduling and attendance at a hearing if the prosecutor objects or if the judge requires it.
